What do I do if I am being sued by my previous landlord?
I left my apartment because they never fixed anything, there was a mold build up in the bathroom and they painted but it was still coming back. I have allergies this year which I never had before and my cousin who has a mild case of asthma had breathing problems. The landlord said that he had the city inspect it and there is no mold problem and he will forward a copy of the report to my lawyer. I left a month before and did not pay that months rent. Should I just pay it to avoid a legal process since I might be liable for their attorney fees?
Well I have pictures of the mold and I told them that in the letter I sent them stating that I have proof and I am breaking the lease due to failure to maintain the premises and that the mold is a threat to my health.
Question about eviction and small claims court?
Recently (sometime at the end of March) I went to court to evict a tenant in Bucks County Pennsylvania. The court didn’t ask for a ssn only a name and address on the form I filled out. My question is will this eviction be on his record and how would the court or credit bureau know who he is without a ssn?
Also I checked on the district courts website and the case number gives me no result! I find it unfair if this man and his family lived on my property for over 4 months without paying rent and it won’t even be on record…
What to ask when finding a good and affordable attorney?
and also what kind of attorney do i need?
my clothing store got broke into through a vacant unit next door that my landlord left unlocked.
do i have a case
Moved out of our rental within 1 day of receiving a note to pay or move out and received an eviction notice?
My question involves an eviction in the state of: Colorado
We couldn’t come up with the rent for the month and landlord gave us until the 1st of the next month. One day prior to the 1st, our landlord gave us a typed notice stating to pay the rent and next months rent by 12 pm on the 1st or prepare to vacate the premises asap. We could not do so and vacated the premises that evening of the 1st. Now 21 days later, we receive a summons in forcible entry and unlawful detainer.
Wasn’t the landlord supposed to check if we vacated the premises before issuing an eviction notice?
Also the date selected on the form to appear in court is for 11 days prior to the date it was filed. Which is way passed due of course. Landlord stated that a Demand for Compliance or Right of Possession Notice was put in a conspicuous place, but just a typed letter, not even signed was placed on our door and that a Notice to Quit was placed in a conspicuous place, but never was and the landlord didn’t even put a date on that document stating when this was done.
Landlord was also to supply us with a copy of the lease agreement with this summons and did not.
What to do next?
Made a big Deposit on a House and landlord spent the money need help on what to do?
I made a $53,000.00 deposit in the house which is a Lease Agreement Contract the landlord made which I sign without having an attorney look at. On the agreement he was to deposit the money into a account and collect interest on it which he keeps and his wife told me they paid on the house and now i’m 2 months behind on my rent and they trying to evict and told me that my $53,000.00 is gone and i wont get it back need help????
Never given a three day notice…?
I was served an unlawful detainer today. The problem is I never received a three notice from my landlord. Here in my paperwork it states that they served me one on March 12th by taping it on the door and mailing. I never received either and I was home. Clearly they are lying and saying they served me when in fact they did not. I’ve been looking this up online and it is illegal to do this and they cannot file eviction forms unless they have formally served me and they have not. I have five days to respond and set a court date to appear in front of the judge and plead my case.
How can I prove they did not serve me. They had served me once back in January and I paid my rent. They did not serve me with a notice in March as they state.
I have five days to respond to this summons. It does not have a court date listed. I assume once I respond to the papers a court date will be set. They have a “copy” attached to my summons saying they served me a THREE DAY NOTICE on March 12th which in fact is NOT TRUE. They never mailed one as they state, and they never posted one on my door, as they state.
My question is can they legally serve me papers w/o ever serving me the three day notice?
I sued our old landlord in small claims and won. He appealed and we both lost. Can I sue again?
I sued our old landlord in small claims and won. He appealed and in turn sued us. In the appeal he hired an attorney and sued us for the attorney fees and an old bill he lied and said we left behind. The judge ruled in the appeal that no one gets anything. Can I sue him again? Because he didn’t return our security deposit in full.
How long of nonpayment to be evicted in Florida?
I could have sworn I read somewhere that you had to be 2 or more months behind on your rent before a landlord can even think of starting the eviction process, has that changed? Or did I read it wrong?! Please clarify. I am 11 days late & shes already threatening, I dont have any reason not to pay but hubby & I just lost our jobs, & are waiting to get some money, but she wont budge.
If given a 30 day notice by a landlord, are you responsible for rent that month?
I was given a 30 day notice by my landlord at an apartment complex because they no longer wanted me there, so I left within 30 days an didn’t pay rent. Was I responsible for rent? I recently received a letter from an attorney stating that I was. Please guide me in the right direction.
