landlord tenant case?

someone stole a few belongings from my friends apartment in september and the landlord said if she secure the apartment it would be deducted form the rent. My friend was pregnant and didnt feel safe so she got window gates and a new door lock installed. A few weeks later thats when she was told it would not be deducted. we are not even worried about her stolen belongings anymore but for her safety as well as her unborn child. Now the landlord is taking her to landlord tenant court and possible eviction. She feel the landlord has not live up to “warranty of habitability”. When she moved in she failed o notice that the kitchen cubburds were filled with insect- the apartment still gets insects and flies. The window to her fire escape wasnt installed correct leaving the window to open from the outside when it is locked on the inside. Then later being informed about this information by the super who in turn has a copy of everyones key………
then on top of that the super said he saw the person enter her apartment but failed to notify police. Which sounds fishy to me who would enter another persons apartment through the fire escape in broad daylight and were there is traffic? But anywway, she has police report- receipt for the work. What other documents do she need to win the case? the only problem is, is that she doesnt have a written document about the work beind deducted form nov rent- all she has is verbal agreement which they are now denying. So she hasnt payed rent becasue she wants to straighten everything out before- becasue it is confusing right now. Can you help assist her in winning this case? If you need more info email me
also when she spoke to the police they remembered this apartment for being robbed before she moved in the same way no forced entry. So She is pretty sure the landlords know that apartment has a history of being robbed and they still failed to secure the apartment from further burglary

do i have to show up in court for this ?

my husband and i have a home in another state and over the past weekend we had to go and clean our house out to rent it again due to an eviction. while there, the former tenant came to a neighbors and started a fight with my husband and i cussing and threats came from her until it progressed to her shoving my husband, spitting on him and trying to hit him. all this happened after i threatened to call cops if she didn’t leave. we called the cops out because of her actions and my husband decided to file charges against her and my neighbor and i had to fill out a witness form. the police said later that we’d have to show up in court possibly next month for the charges. is this true that we definitely have to show up and if so when do they subpoena us or summons us to court after it was filed. this all happened around 1 p.m. on saturday and we havent received anything yet.

Can this tenant be evicted immediately?

Say I have a lease on a house that I both live in and /sublet/ to multiple tenants. One of these tenants and I do not get along, and so mutually agreed that things weren’t working out and that she would find a new place after the new year. I say she verbally agreed to move out on the seventh. She claims she never agreed to that date, and had only planned on moving out “sometime” after the new year. Now she wants another month, but I already signed on a new tenant to occupy her room!

At first, she offered to pay a full months rent for an extra week or two. But then we got into a heated argument when i told her that she had to leave immediately anyway and she claimed to have a /right/ to 30 days notice, and that I couldn’t make her leave until then. Now, she doesn’t want to pay rent at all, claiming that, so long as she can prove that this is her home address (which she can, considering she filed an official change of address form with the post office upon moving in), that I can’t change the locks or otherwise evict her until 30 days after I’ve given her written notice of eviction.

Is this true? And is there any way I can oust her immediately (regardless of whether or not she offers to pay this month’s rent)??
We are in the state of Maryland and I am the only one with a written lease. Those I sublet to are under a verbal agreement to pay their rent and portion of utilities monthly.

Can my parents kick me out on the spot?

I’m 24 years old. I moved in with my parents 10 months ago because I finished my Masters program and wanted to relocate from Connecticut to Florida. I’ve been trying my hardest to get a job but with this job market, employers are hiring people with experience over people fresh out of school. To make matters more difficult, I’ve been disabled since birth and cannot drive so that limits my employment opportunities (I can’t do retail, waiting/serving, burger flipping, etc.) My parents are threatening to kick me out because they feel I’ve had enough time to get a job. I recieve Social Security and food stamps for my disability. I pay for all of my own groceries, but I do not pay rent because they want me to save my money. I offer to pay rent, but they won’t accept it. My social security payment is not enough to pay full rent & untilities for my own apartment.

Given my circumstances, can they just throw me out on the street? What are the legalities behind this? Wouldn’t they have to go through an eviction process? I’m looking for an intelligent, legal-based (Florida law) answer, not “You’re an adult, grow up and move out!” My circumstance is different than a lazy adult who doesn’t want to move out.

What are the chances of us getting our refund back after it has been seized for a defaulted student loans?

I was wondering if anyone else has gone through the same thing. Supposedly we can fill out the economic hardship form and send them all our info and they would work with us and maybe give us our refund back. Has this been a success for anyone, or should I just start packing our stuff and be ready for eviction?
Not deferring, they already took the taxes, and I’m requesting the offset be returned due to the hardship but either way we fall under poverty line because one of us only works part time and gets Unemployment, I don’t work until late into the tax season for maybe 2 months out of the year at MOST. But yes, the link you sent was for a deferral, which I faxed in the beginning of the mess which for some reason they never got and defaulted my loan. If they had that form, none of this would be an issue.

How to I get my fathers stuff out of his house, when his soon to be ex wife calls the cops if I “trespass”?

The house is in Washington State, my father is working over in Florida for months at a time and cant leave for fear of losing his job. My father and his “wife” have been given a 20 day eviction notice. If I try to go to the property she calls the cops. Is there some sort of document or power of attorney form he could fill out giving me rights to the property? I simply want to go in the house and remove his personal belongings.
more info- The house belongs to my grandfather who is now living in an assisted living home. All of the bills are still in my grandfathers name. My father moved in as caretaker of the house with no lease. While he was gone working in florida his wife moved in and registered her cars there, and gets her paycheck sent there. With washington law, that give her rights as a resident, so we have to go through the eviction process to get her out, and since they are still married we have to evict both of them. If he was in town he could simply go in and and get his stuff, but with his work that cant happen. She has already starting selling his tools and he has already lost a few thousand dollars in belongings.

I am not sure whether to ask my Maid of Honor to step down?

Here is the break down …I am getting married in 8 months and yes I know there is some time…my Maid of Honor is going through an awful time in her life right now and I feel like to have her focus on my life is selfish of me I asked her about 11 months ago to be in the wedding….background for you: My maid of honor just graduated from law school passed the bar – broke off her engagement can’t find a job and now is facing eviction if she can’t find money to pay her rent….with this economy I think it is bad…I asked her previously in august or so before things became so bad …to contact my mom and the other girls to discuss the shower (all of them live hours away so email is the best form of communication along with phone) and we needed to book the times and dates as many people are coming in from out of town…she told me that she did contact everyone and I came to find out that she never once did so my mom is working with my aunts and the other girls now to make sure everything is set…
this past weekend I asked all the girls to come into town so they could have enough time to pick a dress and make sure it was ordered in time…they all did except for her she told me that she needed to use her grocery money to drive up her (when other girls offer to carpool) and then the rest of the months rent to pay for a dress….I told her that I could cover it for her and that the other girls could drive her ( they do not know anything about her sitation partially because it is between me and her and partially because none of bridesmaid’s know each other) —she never showed…I feel like if I continue to ask her to do stuff its either a big ordeal because of her situation or she is not doing it…
I asked her to look at dresses with me and I drove to her and she never showed up …I am having trouble finding the dress and I need to soon and she told me maybe I was meant to be miserable like her if I can’t find it….

She is not financially or emotionally able to be there for me and I would not expect her to because of everything going in her life and I am trying to be there for her but since she is not I feel like it would be selfish to continue to ask her to do anything for the wedding….I am thinking of asking her to be a guest considering circumstances and to help her focus on her life more….

Oh the reason I said emotionaly is because my fiance’s sister is giving me hell and when she does I usually call her but she told me to suck it up so I am just not talking about and keeping it between me and my fiance…

I am being really awful because I feel like it would be selfish to ask her to do stuff that I know she can’t afford and I know I can’t cover all of it for her either…

I don’t want to ruin the friendship but she is her main concern right now – finding a job making a living and working out the stuff in her life…
I am only concerned for her…and the other girls are doing their best to help but everyone is financially stuck its the economy I just feel like it might be better for her to focus on her and not try to help me out…I want waht is best for her and love her dearly and i don’t think this is the best…

Landlord is charging me $1058.37 for last apartment can they do that?

I recently moved from a 2 bed to a 3 bed. I put down a deposit of $350.00 on my last place. When I moved out the place was not pristine, but it certainly was not damaged in any way. I left a kind of dirty bathtub, everything else was scrubbed. Didnt mop the kitchen floor or anything but cleaned the appliances and shampooed the carpet etc.. I got a letter charging for everything under the sun adding up to the amout above.Minus the 350 they want me to pay 708.00 I was shocked. I think they are harassing me as I am taking them to court for a wrongful eviction notice and they know I have a lawyer, do I have any recourse for this assanine amount of money they want me to pay? I got 3 quotes form maid services and the top amount to clean a really filthy apartment would be no more than 250 and that a really dirty place.
I guess what I am saying is the place was not dirty beyond normal wear and tear and they are charging for things I know I cleaned. They are even charging me for carpet I steamed and nail holes etc…
in my defense, the place was not damaged and my apt only charges $per nail hole so that was not the all of it. Point is they are charging me for things that I did perfectly and should not be charged for.
