Can Tenant file a lawsuit against Landlord, NEW YORK STATE?

In Court papers my landlord claimed that my family and myself were squatters & moved into his property illegally, prior to the court he brought the sheriffs to throw us out but they instead informed him of following proper procedures, he has turn the water off, cut the lights and a lot of other stuff, just recently he was caught looking through the window while I was getting dressed after a shower.
The judge dismissed 2 of LL cases, there’s been 3 stating I was a squatter, the landlord and his attorney cancelled the other one. But, now I have another court paper stating that I am a month to month tenant and owes him rent and he wants me evicted. I have the money orders for him but he refused it. I have found another place and will be moving out by tomorrow, I will also take the money orders to court. Can I file a lawsuit against my LL claiming that I was a squatter and now he states I’m a monthly tenant. There are people waiting to move in and they are also calling me a squatter.
I was renting without a lease with the landlord legally, paid rent until February when the landlord stopped taking the rent. I have the money orders dated for feb and mar.
estielmo, you have it all wrong.
I did move in with the LL approval, he and my husband do not agree and he wants us out.
He claimed I was a squatter as wanted the cops to kick us out.
I have all utilities turned on, I did make complaints to the code dept and the utilities was turned back on after they got involved.
I am moving on, but it was kind of difficult to find another house with a lot of kids. I have my brother and sister kids, as they are in Iraq in the war, plus my own kids and my step kids, so it took a long time to find any place, we have since bought a house and will be closing on 4/1/08, so i am out. I still have the last two months rent for him in the form of money orders dated, 2/1 and 3/1.. But on second though i may just keep it as he has my security deposit which was a total of 2 months rent combined. It will take a lot to go into all the details o i tried and made it short and now i am being ridiculed by the readers for not moving.. All I asked was can I sue him

Buk – I have reached my answering limit for the day, but I cannot let your last question go unanswered?

I consider myself somewhat of a scientist as well. My landlord came to me the other day and told me that I would have to get rid of all of the scientific experiments that I grow in my kitchen. When I tried to explain to him that I could not just throw them out, he started shouting some jibberish about “eviction” and “condemmed” and “board of health” and “change the locks”. I just tuned him out and am hoping that if I just ignore it, the whole situation will just go away. So, yes, I feel your pain. We scientists must form a united front and not let the non-scientists of the world bring us down with such intimidation tactics.
Laura Palmer: Mark my word, when I win the Nobel Prize, I’m using the money to buy this damn tenement so I can fire him and grow my experiments in peace.
Oh Buk, you’ve come to the right place. I have been stockpiling government cheese for the past 11 years. I ran out of room in my refrigerator (those experiments take a lot of space) about 10 years ago so I’ve been keeping it in the hall closet ever since. You can have as much as you like.
Undercovernudist (I can’t recall ever typing that word before): You can start by emailing me your credentials. If they pass inspection, I will have you sent originals of your birth certificate and social security card as well as a vial of your blood. If you make it past this round of the “interview” process, you will have to pass government clearance, you know the usual. After that, I’ll interview you for the position of my dog walker. If you’ve proven yourself after a year, I may interview you for the position. Thanks for your interest!!

cnataw: Buk gets first priority and I hear he’s hungry. He may drop some crumbs and those, my friend, are all you!

Is a seven day notice to cure the right legal form to file?

My fathers owns a few houses and I do the legal paperwork for him. We are satisfied with most of our tenants with the exception of one. This particular tenant has broken his leas by having more people living there than what is allowed on the leas. We are positive that he has an additional family living with him. According to the lease we established with him only his family (his wife and two kids) are allowed to live there. Also we do not have a good relationship with the additional family we believe to be living there. I know that a 30 days can be filed, but I do believe I can file a 7 day notice with cure. The man clearly violated his lease by having an additional family living there and we can cite that on the form. If the additional people do not leave thereby allowing the tenant to violate his lease, do I file an eviction.

I need to figure out his soon. My parents are going on a trip in the morning and I want to complete all the paperwork tonight.
I live in the State of FL
And the people on the lease AND an additional family is living with them. Thans for the answers so far.
