The landlord had an agreement behind my back?

with the other tenant in the home that he rents as two apartments.
I was under the impression we shared electric as as HVAC and hot Water heater which are on my circuit breakers.
The tenant has her own for lighting and other things.

When I went to the tenant and requested her share of the electric, she responded that she pays the landlord $25 a month for the HV AC and hot water of which does not make a dent in the bill of which I had was $1278 for three months.

I feel this is fraud on the landlord’s part and want to know how to pursue this.

He said I should sue the other tenant but she is already being evicted and was able to not pay anything during the time she was here except give me migraines.

Plus he had a lease agreement with her.

My attorney had me file a rent escrow plus the landlord is trying to remove me from the property as well and I have been here two and half years and did not have problems until the new tenant moved in 11 months ago.

I have an inspector coming in on Wednesday to check out my complaints.

It kinda sounds like this is barreling towards small claims court and it will be decided there. I’d just keep putting all your rent in escrow and the judge will decide it. I think you will have to move out, but would you want to stay in a place like that anyhow. You can take them to court or wait for them to take you. If you left and they never did take you to court you could cut whatever deal you thought was fair (you could do that now too), or keep the money in escrow if they never pursue you. If you make a deal outside court get the attorney to draft it up and make sure everyone signs it and you get a copy.

you had the “impression” which does not mean it is what it is. whats it say on your contract? does it specify? He is the landlord and can charge what he wants and it can be different. but yeah I can see how this is messed up and feel sorry. my dad is a landlord and didnt ask him for advice for an answer.

Any agreement between the landlord and another tenant is irrelevant. What does YOUR lease say?
