can a landlord or manager force you to sign something that doesn’t explain anything?

we live in a mobile home park and the owner is forcing us to pay and forcing us to sign a paper from the “state” but the contract or form he wants us to sign doesn’t say anything, he comes and threatens us with eviction and with taking us to court we have lived here for over 15 years never had a problem until now he is trying to charge us 500 dollars for a light pole that they just installed, but they are already charging us for electricity and they have not connected the pole yet, everyone else has signed but my parents and another tenant, the management threatened others with eviction and other treats . its been about 2 months with they have been haggling us, wouldn’t they have done something already if they really wanted too kick us out? what can i do? please help

What Is My Legal Option? Landlord VS. My Visitation Right Under Rental Contract?

Recently the landlord has expressed disagreement on my visitation right and did inform my girlfriend that I can only come twice every 15 days because the landlord did not like to see me every time when my girlfriend opens the front door. The landlord said that I am here everyday and did not like the idea. My girlfriend and I are upset with the landlord that I did inform her “I (the only guy) have the right to visit my girlfriend at anytime only when she is home as part of the rental contract” as well as stated my visitation right on the contract. My girlfriend and I have talked to the landlord along with her attorney today to try to find a solution for both parties even though I do not need to negotiate with her since the contract is clearly stated my visitation right! The landlord’s lawyer has stated in her favorite (of course he did since he works for her) that the contract term may not necessary hold up (valid) in court due to term not specific enough. What is my legal option?
I helped (typed a rental contract) my girlfriend (tenant) 2.5 weeks ago to rent a room from a woman (landlord) who own a house (either still paying for the mortgage or completely paid off) and live there also. Before they (tenant & landlord) signed the rental contract, the landlord has stated that she does not want guy(s) to be in the house. That raised my concern and immediately I have informed the landlord that I (the only guy) have the right to visit my girlfriend at anytime only when she is home as part of the rental contract. The landlord said sure and no problem. I have also put the visitation right in contract stated as follow: “EXTRA VISITORS: The Renter can invite the following visitors: ___BOYFRIEND NAME____ to visit anytime and stay overnight occasionally. Other visitors may need to be notified to The Owner.” I informed her to take time to read the contract carefully and agree to all terms before signing.
Since signing the contract, I have been coming to my girlfriend’s room only (with door closed) from the front door through the living room, use the bathroom (no shower) when necessary, and help her cooking in the kitchen only if she needs help (I helped her twice). The first two weeks I helped my girlfriend to setup furniture (sofa bed, computer desk, entertainment center, small refrigerator, etc.), cleaning (floor, windows, closets, etc.), and other tasks to make her room looks comfortable. Since my girlfriend has 3 jobs, I only come to visit her between the hours 3:10pm to 3:55pm (break between 2 jobs), 10:35pm to 11:30pm (she needs ride home after work and spends time with her to talk about the day), and her days off (usually 2 days/week during afternoon after 2:45pm to 11pm or in the morning between 9am to 3:50pm), Christmas Day morning around 10:30am and evening no later than 11pm). I did spend the first night until 2am to set up her sofa bed for her to sleep on.
I never did spend overnight in her room even though the contract has allowed me to do so occasionally. The landlord has used excuses: noise – we do not make unnecessary noise except when opening old doors and walking on old hard wood floor; arguing with me on contract keywords such as “visit” means not everyday, “occasionally” means not visit everyday even though the word intends to apply on overnight stay only, etc. What would you do? I did inform the landlord and her attorney that I will vigorously held her accountable with the rental contract (my visitation right) under the law!

Why is it possible in america to abuse the judicial system and render a family homeless?

Sam keller here. I am the guy who is being scammed out of his house in the town of windham. Here is an update of our lives and how it is still being ruined.
Mr. Webster was finaly told by the court to post $22000.00 back rent. He did not . Court set eviction for sept.19 2008 9:30 am .
On thurs afternoon Sept.18,2008 Mr. Webster filed for bankruptcy granting him an automatic stay.Mr. Webster i have been told has fied for bankruptcy in the past,less than 5 yrs ago.He did not submit the required credit counseling form or the fee.
I also believe he appealed the case or tried to get an appeal to the state supreme court and was denied .
Our home has gone past the 20 day summons from the foreclosure.
My family and i have applied and are now recieving welfare .
I am going to file for bankruptcy this week to try and protect the home and vehicle.
It will also dismiss the fraudelent $500000.00 lawsuit mr. Webster has filed against me,my wife and a 3rd party.
I have had more people interested in purchasing the property but am still unable to access my own property.
This is outright fraud and I can’t get anyone to look at it.
I am unable to afford an attorney anymore ,so I wait around another year while I watch my home and work of 20 years slowly and continually being washed away by our great justice system ….. thankyou america.

and as I understand it ,he can take it to the surrogate court yet………..

Did you know if you are a tenant in NY State you have more rights to the property you are renting than the landowner? You can have the landlord arrested for trespassing,legally deny him access to the property.You can stay your eviction by issuing a check than putting stop payments on it.After receiving your eviction you can appeal to county court for any reason you deem fit.Where it will then sit several more months .You can then sell of the properties and assets of the homeowner without consequences. This is what is happening to us in Windham ,NY . Ronald T. Webster and Barbara Webster of 332 state route 296 in Windham,NY originally home of Appletree B&B/Keller Landscaping are now in debt to me for Well over $20,000.00 rent or 10 months free to date.They have sold our hot tub along with many other personal assets.Not to mention denied access to realtors and prospective buyers causing the loss of a $465000.00 SALE of the home.Greene county Court judge Lalor supports these actions.He granted them a stay while they owed me 7 months rent.Judge Lalor would not even allow us access to the property to get clothes for our children 2,4,and 5.If it wasn’t for the generosity of the commmunities,food pantries and relatives we would have nothing.Not even a home .Since I am supporting these criminals and own a home ,our primary residence,We are inelgible for any kind of legal aide ,public assistance or any other state service.This is a clear violation of my and your constitutional rights .We are paying to support criminals . The system protects criminals.I must ad that Senator SEWARD,legislators and other gov’t officials,state agencies are of no assitance whatsoever leaving it in the hands of our great judicial system.I think it’s great that the state supports criminals so I can watch my work of 20 years go down the tubes because of their bureaucratic nonsense.No matter what you read here this is happening to you to. Can my landlord charge me for this?

I moved all my belongings out and am no longer at the residence. We are in a dispute of “not giving them the proper notice”. I rented 4 weeks of July and the first 4 days of August. and moved out Aug.6 (I know if anything I owe them for that extra week though. Their just claiming more thats why we are in a dispute. We had an oral agreement to pay weekly and had no agreement on how long I was to stay or when I would have to give notice.

You then have five days (excluding weekends and legal holidays) to respond – also in writing – to the court. If you do not respond or a judgment is entered against you, the clerk of the county court will issue a “Writ of Possession” to the sheriff who will notify you that eviction will take place in 24 hours.
I know I cannot win anything on YA but I was asking if anyone knew anything about this and what the terms meant.

It was also a room I was renting from them out of their house that they lived in so I don’t have anyone to contact that is higher in the complex
I never gave written notice because I did not know that was the law and at the time they were fine with that. Now I feel as if they are just trying to get money out of me. I had agreed to pay them for the days from Aug.4th to Aug.15 and they did not accept it and said they would only settle for 800 which would be for $400 for the weeks in August and $200 for the 15 days notice and whatever the interest would be (which doesn’t make sense, Im not wuite sure if he knows what he is talking about).
I am trying to resolve this with the landlord and dont want to cause issues but I dont want to pay an amount that he assumes I owe.

My question involves an eviction in the state of: New York

Hello, I’m renting out a house and the tenant hasn’t paid the rent for 3 months. He doesn’t answer the phone, and I live far away from the house I’m renting out so it’s very difficult for me to go there and check up on what he’s doing. In anycase, this person doesn’t seem to be very trustworthy, and I want to take legal actions to evict him.

I never took legal action against anyone before I’m really new at this and need some newbie advice. I’m wondering, can I file a claim and summon him to small claims court? I have copies of the tenants rent application, rent deposit form (signed), driver’s liscense and some other documentation such as pictures of his pets etc. The only problem is that to this day, he still has not signed the lease contract, I only have a copy of the lease contract with my signature and date. I’ve never been involved in any legal conflicts so I’m totally ignorant as to what I should to or the steps I should take to take this individual to court, so I have to ask some stupid questions:

1. Do I even have a case legally without a signed lease contract from the tenant?
2. How do I file a small claims court case?
3. Are eviction cases handled in small claims or superior courts in NY?
4. If eviction cases are only handled in superior courts, do I need a lawyer, and in this case what about my 3 months rent money?
5. My house for rent is located in Long Island NY, how do I locate a small claims court near by me?
6. What is the legal limit for SCC cases (I’ll be sueing for 3 months rent which amounts to 4800 dollars).
7. Any other suggestions and or information that I should know but missed.

Making a withdrawal from 401K?

My husband is in the process of filling the form out to withdrawal from his 401K. For the reason he put to prevent eviction. We own a house and we are having trouble paying not just the house bills, but all of our bills. He is asking for $5000. I know as far as paper work and rules that he is eligible for the actual withdrawal, but how do we prove that we are in a tough situation as far as paying everything?
We haven’t actually gotten a foreclosure notice….I don’t know why it says eviction (isn’t that for renters)?
Anyway can someone help me with this? He asked me to mail it tomorrow, but I know they will need some kind of verification or proof.
What can we show them?….it’s simply a combination of things.
We had a situation this summer which caused us to be behind ever since.
We are not actually $5000 behind in mortgage, just wanted the funds to get caught up with our mortgage and bills….we ARE behind in our mortgage payments though.
They have already sent the form for us to sign. It just says something about verifying this…and I have no idea how to verify a multiple of situations…..because it’s not solely a mortgage problem.
well then tell me what ARE we supposed to do?? Make too much money for government assistance. Not enough to get back on our feet.
As I said, a situation came up this summer and we have been behind ever since.

Apt. MISERY — need help. Landlord promised a quiet environment verbally but promise was not kept. It has been?

This place is awful– police have been out here multiple times for noise complaints but its been going on for 2 months now and apparently they never cite them because “its a university town and kids party”.
I have lost sleep, been placed on meds for stress and my schooling has been ruined – focus concentration so bad I had to drop from my own classes. I cant afford a good attorney and the landlord wont let me out unless I sublease which means I am responsible if someone damages the apartment. I’ve contacted everyone, including the press and the a police captain and a police colonel. Anyone have any ideas as to why the landlord wont admit his lies and let me out? Especially as its been making me ill?

Can I get personal property back after it was taken by the leasing company that also evicted me?

Last Oct I was evicted from my apartment for failure to pay rent. I lost my job and outright didn’t pay more than a portion of one month of the three months I lived there.
Prior to the eviction, some unfriendly women working for the Lend leasing company came banging on my door so loud I jumped out of my skin. I opened the door and 2 women pranced in and continued to insult me and demand I pay them rent money or they would take my things.
They helped themselves to my son’s flat screen television, his xbox 360, his xbox , my stereo, vcr, and dvd player and also another small flat screen television that did not belong to me but to a friend who had temporally stored it there.
They were extremely disrespectful. I in no way confronted them or was hostile but just stood dumfounded and ready to cry. I had recently lost my job along with self esteem and confidence.
I did go to court and did not disagree with the eviction. The day I had to be out I packed my belongings the best I could, knowing the leasing company would physically be removing my belongings from the apartment to the parking lot. The law officer showed up that morning and I asked him if I needed to leave my apartment. He said no stating that i was cooperative. I was in the apartment still packing when I heard loud crashing sounds. I came out to see one of the workers throwing my backback over the ledge of the third floor I lived on. I again almost began crying. One of them said it wasn’t anything breakable. I don’t think the worker realized I was in the apartment when he threw the item. I asked that they please not throw my things in such a manner. I didnt realize untill days later that there was actually breakable items in the backpack which included a pair of binoculars and a chi hair straightener.
I was inside the apartment looking in the phone book for a moving company and one of the Lend ladies entered my apartment began insulting me again stating she couldnt believe I didn’t know where i was going or what i was going to do with my belongings and why was i so irresponsible and I was taking up her men to move my stuff.
Why did these people insist on kicking me when I was down? I am in no shape or form a confrontational person. No, I didn’t pay rent and I was not uncooporative with the eviction.
It has been almost five months I have not payed the money I owe the leasing company. I am going to visit my son in PR this weekend. I also lost custody of him this past year and have not seen him for almost 2 years. He has been asking on the phone about his xbox 360 and it really kills me. Losing my son has been the most painful experience of my life. I know what has happened to me is a result of poor choices on my part but it still really hurts especially when it comes to issues with my son.
Long story short, what happens to belongings that leasing companies take in cases like mine and is there a chance of possibly getting them back.

Will my Renter’s Ins. that doesn’t discriminate against Pit Bulls override my landlord’s policy that does?

I’m trying to rescue a Pit Bull. My renter’s insurance policy doesn’t discriminate against any breeds (kudo’s to them!!!) and will cover any damage caused by the dog if anything ever happens. Does my policy override my landlords homeowners policy that says “Breeds of Concern” (which includes Pits) are not allowed?

Would signing a legally-binding contract releasing any and all liability for the landlords work?

I guess I need an attorney…

When can we move without breaking our lease if landlord in foreclosure (just posted, sale 4/7) in Texas?

We just found out Saturday that our landlord is in foreclosure via a letter from an attorney. Monday, the landlord said it was a big mistake and they just hadn’t paid property taxes yet. Checked public records and that turned out to be a lie. Landlord is MIA now. I checked pub records again today and the house was officially posted Monday (after I’d already checked), set to auctioned on April, 7th.
Rent is due on Friday but we need that money to move. When can we move without defaulting on the lease? The Tx Property code says the lease is void once foreclosure TAKES PLACE…Since it’s been posted already is our lease void or do we have to wait until April 7th?
The landlord is a huge liar (confirmed through pub records), and had a suit against him for non-payment of rent / eviction in Nov. Obviously HE was renting a house and defaulted and HIS landlord sued him and won ($8,000). What can we do? We don’t want him suing us for breaking the lease!!
Spoke to a real estate attorney, but he said that we’re basically screwed….
Getting married in 57 days and have a non-refundable honeymoon booked in 58 days!!!
