Can i countersuit my landlord ?
i am moving and the landlord says to pay for the lease until the end of the year. but i am moving on august. Also there is a security deposit that is suppose to pay for the “damages” that are on the apartment. But, there is no damages. The landlord “threatens” to turn the matter over to an attorney. I was wondering if i can counter suit the landlord for lack of support to find the people who vandalized my car. The landlord tells me i cant see the tapes that contain information leading to the vandalism because i did not report the police. Please, can someone help me ?
You’re free to sue for anything you’d like. The real question is: can you win? Only a lawyer can answer that question.
No you cannot. You pay the rent as required by your lease. You can ask the landlord for an itemized bill of the damages to the apartment. That includes cleaning it.
NO! They are not asking anything against the law. YOU are the one breaking the lease!
Landlords are NOT responsible for crime in the area so they have no legal obligation to lend any support in finding them.
You have no legal grounds to counter sue for anything! Pay what you legally owe and deal with it!
When you moved to this apt, you signed a lease that makes you responsible until it expires. If you move early, you are in breach of the contract. The landlord can use your deposit to deduct cleaning fees and/or things are are above wear n tear and unpaid rent. Now, regarding the vandalism in the bldg. A landlord is not responsible for theft in the property. This is why getting renters insurance is for and car insurance. You need to file a police report and call your auto insurance agent and file a claim.
