Tenant/Landlord I won a court case but was never paid?
I won a tenant/landlord court case in local court. The tenant appealed the case to an arbitration hearing at the county court level. I presented in front of a panel of attorneys and won. The tenant has not paid me what I have won after winning 2 court cases. What should I do?
How long does the tenant have to pay after receiving a letter from the courthouse?
Contact your attorney.
Go back to court and try to get a wage garnishment order, and if you do, notify the tenant’s employer to have the money taken out of/her paycheck.
The court simply decide if you have enough evidence to prevail or the defendant has enough evidence to prevail.
The court is not a collection agency, once the case has been decided it is now up to you to decide the method of how to collect from the person that lost.
There are several means of doing this
#1 Garnishee one or both of their wages at their job. There is a process of doing this, you would have to find out this method.
#2 You can attached their bank accounts, again you would have to find out the method to accomplish this.
#3 You can get a collection agency to do the collection from the ones you got a judgment on.
#4 you can attach any house or other property they have ( you would need to go to the county court where their property is located to file this lien)
Going to an attorney would not help, they are not collectors. They will take your money for consultation and point you in the direction of a collector.
I hope this has been of some benefit to you, good luck.
“FIGHT ON”
Judgments are due immediately.
You need to request from the judge either using a collection agency or garnishing the bums wages.
