I am renting a condo that is in foreclosure;do i keep paying rent? I was told not to by a foreclosure attorney?
I have been getting the notices for a couple month now and the “landlords” say it is nothing to worry about. however i pay in cash and i have no lease. the owners have not paid since 2007 and a heiring is coming soon to put the place up for sale, some are already for sale. I spoke with the attorney and he said to not pay rent that what they are doing is a 3rd degree felony. Should I stop? Is he right?
lol if the attorney told u know then don’t…you can live in the condo rent free until its sold
Unless your state has some law that says you can stop paying rent while the property is in foreclosure, and I know of no state with this law, the attorney you spoke to was incorrect.
You continue paying rent as you always have, but I recommend you switch to checks so that you have some sort of receipt. The foreclosure does not affect this in ANY way.
Once the property sells, you will be notified of who you pay rent to from that date on and they will also let you know if they want you to move out.
I’m guessing that your ‘attorney’ got his law degree in a box of Cracker Jack. It is NOT any sort of felony to fall behind on mortgage payments. You need to continue paying rents as agreed UNTIL ownership changes hands to a new owner. At such time, your rents are due to the new owner. Under newer federal law, the new owner must give you at least ninety days to vacate the premises, after ownership changes hands.
And find yourself a NEW and QUALIFIED attorney.
That is the dumbest attorney ever. This is far from illegal, not even against civil law, let alone criminal. I am amazed anyone that stupid passed the bar.
No, your landlord is breaking no laws and is legally entitled to collect rent. It you be YOU breaking the law if you were to illegally withhold rent, as this piss poor excuse of an attorney instructed you to do.
