Filing bankruptcy. Will my landlord find out?

I am filing Chapter 7 personal bankruptcy in the state of Florida.

I was told by one attorney that my landlord will not be informed since I am not including my lease agreement as one of the creditors.

Now the attorney that I hired says that they will contact my landlord and inform him of the bankruptcy.

What gives? Why do they have to tell him if I plan on continuing with my lease?

  • Landlord says:

They do not tell him, a lease is not credit. The landlord is not effected in any way and is not informed.

I would ask your attorney why he’s doing that. And make him provide written documentation as to where it states that he has to.

You’re already in a contract with your landlord. And so long as you keep paying them and they aren’t going to sue you for not paying, then there’s no reason for them to know a thing. If you were writing off a debt that you owe them for past due rent or something in your bankruptcy then that would be different.
