The town notified her in 2008 not to rent the apartments by letter,courts, and her attorney.

    So? And how were you harmed by this? This is between the landlord and the town.

    You cannot sue just because you don’t like someone, you can only sue if you personally are harmed.

    Quite possibly. The landlord cannot be allowed to profit from an ongoing violation by charging you any rent for premises that are not legal. The lease is a “breach of warranty” in that the landlord does not have the legal power to extend possession to you, let alone for money.

    Similarly, if you have an authorized apartment, but the landlord refuses to provide a safe living environment after having been notified of any fire code or building code violations, you can sue to have your rent reduced by an amount to be determined by the court, as appropriate for renting an unhealthy fire trap rather than the apartment you assumed was in full compliance with the laws.
