Can a landlord put in the lease that I am waiving my rights to an eviction hearing?
I have a boss that says his attorney said that he has some new leases for him and that he can have it in his lease that the tenant gives up there right to an eviction hearing and that he only needs to give the notice to quit,the only reason I ask is because I like my boss and do not want to see him get himself in trouble because of some misguided information.
Information in a lease cannot be added after the lease agreement is signed by both parties. To add anything, the landlord must have the new lease signed again by the people involved, and it can be very hard to put forth a new lease within the time limits of the original lease.
Anyone that would sign such a lease as you mention, should be locked up for their own protection, as no one in their right mind would sign such a document.
A lease can’t override the law.
I’d bet that the wording in question only guarantees that the parties will agree to “arbitration” vs. court action. And in most areas 30 or 60 day notice is all you need anyway. Anyway, if his attorney is giving him this info it should be reliable, shouldn’t it??!!
